Online sales terms and conditions

1. Definitions

“We”, “our”, “us”, “megabus” and “SCCL” means our company, Scottish Citylink Coaches Limited registered address: Buchanan Bus Station, Killermont Street, Glasgow, G2 3NP. Scotland company number: SC091931, VAT number GB 878 2452 85. “Terms” means these online sales terms and conditions as amended from time to time.

“Our website” refers to uk.megabus.com

“Terms” means these online sales terms and conditions as amended from time to time.

“Reservation” means the booking you make for a megabus.com journey on our website, from a kiosk or with one of our authorised agents.

“Kiosk” means a self-service ticketing machine.

“Ticket” means a reservation number (paper or electronic). These can be purchased on our website, from a kiosk or with one of our authorised agents.

“Operator” means the bus company that provides the coach service for your journey and is specified in your reservation.

“Discount code” means a promotional discount code, Tesco Clubcard Voucher or money off code.

“Discount code-specific terms” means the specific terms and conditions governing the use of a Discount code.

2. Introduction

These Terms (and our Terms of website use) give you information about us and the terms and conditions by which we sell all Tickets listed on our website.

These Terms apply to any contract between us for the sale of Tickets to you. Please read these Terms carefully and make sure that you understand them, before accepting the Terms and ordering any Tickets from our website.

You will be asked to agree to these Terms before placing an order. If you do not accept these Terms, you will not be able to order any Tickets from our website.

Our contract with you will begin when we dispatch the Tickets to you.

We amend these Terms from time to time as set out in the ‘Our right to vary these Terms’ section below. Please check these Terms every time you wish to order Tickets, to ensure you understand any updated Terms.

4. Use of our website

Your use of our website is governed by our Terms of website use.

5. Your personal information

We only use your personal information in accordance with our Privacy policy. Please take time to read our Privacy policy as it includes important terms which apply to you.

6. General

You must be 18 years of age or over to make reservations using the payment methods on our website. By using our website you confirm that you have the legal authority to enter into the Terms, including instructing us to collect any payments from a debit or credit card, and to use our website in accordance with these Terms and the Terms of website use. You also confirm that all information supplied by you in using this website is true and accurate.

The contracting party for your journey is shown in the relevant Conditions of carriage.

Tickets are sold through this website for megabus.com branded services and for those of other selected operators. By purchasing a ticket, you agree to accept and be bound by the Conditions of carriage for that Operator. Where a route allows tickets to be purchased on board, these will be sold at a price set by the vehicle’s Operator.

All tickets are for single journeys only and no additional saving is achieved by purchasing two single tickets for a round trip.

When you buy a ticket online on megabus.com or at a Kiosk, you must check your journey itinerary thoroughly before making your payment. It is your responsibility to ensure that all of the details you provide to us are correct and accurate, and no refunds will be given.

When you make a reservation in person from a travel centre or agent, you must check that you have been issued the correct ticket and that you have received the correct change.

When you make a reservation by phone, the agent will confirm the details of the booking with you. You must check that all details are correct on your Ticket.

No matter how you make your reservation, you must tell the agent about any apparent errors at that time. We will only consider claims about errors in exceptional circumstances, if you can show to our reasonable satisfaction that we made an error.

If you are booking an international journey, we, or our sales agents, will need to take information related to your identification documents and may be required to provide this to border controls in order to permit you to travel. We reserve the right to cancel the reservations (whether confirmed or not) of any customer whenever it is necessary to comply with any governmental regulation, upon any governmental request for emergency transportation in connection with national defence, or whenever such action is necessary because of weather conditions or other force majeure circumstances beyond our control.

Failure or delay by us to enforce an obligation or exercise a right under these Terms does not constitute a waiver of that obligation or right.

7. Price of tickets

Ticket prices on our website are quoted in sterling (£) and exclusive of VAT, as transport tickets are VAT exempt.

We take all reasonable care to ensure that ticket prices on our website are correct at all times, but we cannot guarantee that they always will be.

It is always possible, despite our reasonable efforts, that some Tickets on our website may be incorrectly priced. If we discover an error in the Ticket you have ordered, we will contact you to inform you of this error and we will give you the option of continuing to purchase the Ticket at the correct price or cancelling your order.

If the pricing error is obvious and unmistakable and could have reasonably been recognised by you, we do not have to provide the Tickets to you at the incorrect (lower) price.

Ticket prices can change due to demand and seasonal variation, but this will not affect any order you have already placed.

From time to time megabus.com will sell promotional Tickets and we encourage customers to take advantage of these offers. However, if we discover atypical usage of the Tickets you have ordered, we reserve the right cancel or limit your Tickets. If we find it necessary to take such action, our liability will be limited to the value of the cancelled transactions only.

A single booking fee is charged for each transaction.  Multiple journeys can be booked in one transaction. 

You may choose to have your reservation number sent to your mobile phone by Text message

Journeys booked by phone with our Sales Contact Centre are the same price as those online, including booking fees.  Calls to the Sales Contact Centre are charged at 65p per minute plus network access charges and may be monitored for quality and training purposes.

Where there is more than one person travelling on the same Ticket or where one person buys a Ticket for another, the buyer is deemed to have acted as agent for the travelling party and accepted these Terms and the relevant Conditions of carriage on behalf of each member of the travelling party.

There are no names attached to a Ticket; the billing name may appear on the Ticket but the buyer does not have to travel.

8. Payments

Website

We have taken many steps to ensure the security of your payment transaction, including adopting appropriate industry standards.

All payment transactions are handled by our partner Worldpay, a secure payment processing provider. Your credit/debit card and related personal details are only collected by Worldpay in order to process your order.  You can find Worldpay terms and conditions, and privacy and security policies at www.worldpay.com.

Payment must be made by you at the time of ordering. We cannot accept payment by cheque or bank transfer.

Authorised agents

Payments to authorised megabus.com agents are made using the agents' payments processor, or cash.

Kiosk

Payments made at a Kiosk can only be made with a credit/debit card using our partner Creditcall. You can find Creditcall terms and conditions, and privacy and security policies at www.creditcall.com.

Cancelled payments and payment recalls

If your payment is cancelled by your payment provider or we receive a “chargeback” or payment recall, your Tickets will no longer be valid and we will not honour them for travel.

9. Discount codes

The details of a Discount code will be set out in the description of that promotion and the Discount code-specific terms.

  • Discount codes may not be used in conjunction with any other offer
  • these Terms,  Terms of website use and any Discount code-specific terms apply in respect of any orders placed using Discount codes
  • by confirming your order using the Discount code, you are accepting each of these terms and conditions. Please read each of these terms and conditions carefully before confirming your order. If you have any queries on any of these terms and conditions, please contact us before using a Discount code
  • the Discount code will expire on the date specified in the Discount code-specific terms  relating to the Discount code, or subject to availability. You cannot use the promotional Discount code after this date. We reserve the right to vary or discontinue the discount codes scheme at any time
  • we want  our customers to enjoy discounted travel, but if we discover a breach of the Discount code-specific terms , we reserve the right to cancel or amend your Tickets. We will give you notice using the contact details you have provided
  • you may use your Discount code to pay for part of or an entire journey. Unused credit cannot be carried forward and is forfeited
  • your discount codes are unique and must not be shared
  • discount codes remain the property of megabus.com
  • discount codes have no cash value and cannot be exchanged for cash
  • discount codes must be used at the time of purchase and cannot be applied after payment is completed

10. Validity and use of Tickets

Tickets are only valid for the service(s) you have booked. If you miss your service you will not be permitted to travel on a later service, unless you purchase a new Ticket. If you arrive early enough for another service you will not be permitted to travel on that earlier service, unless you purchase a new Ticket. You cannot start or end your journey at any intermediate stops and must travel the entire journey between the origin and destination, on the date and at the time(s) shown on your Ticket.

Tickets cannot be resold.

Concession and discounted Tickets are only valid with the relevant and accompanying concession or discount card, which must belong to the passenger travelling. Evidence may be required upon boarding to verify that a child ticket is valid, between 4 and 14 years of age. In the event you are unable to prove the age of the child, at our discretion, an adult ticket may be required to be purchased.

If you do not comply with any condition that governs the use of a Ticket, the staff or agents of the relevant operator may withdraw the right to travel or charge a penalty fare as detailed in the relevant Conditions of carriage.

11. Discounts and concessions

A 10% discount on standard fares is available on certain journeys for children and young people aged between 4 and 14. The discount is only applicable to passengers in that age bracket at the time of travelling

A 10% discount on standard fares is available on certain journeys for holders of the TOTUM card.  If you have used your TOTUM card when making a reservation you must present your valid card to the driver or company official when boarding their service and be in possession of it throughout the journey.

A 10% discount on standard fares is available on certain journeys for Stagecoach and SCCL Employee and Privilege Passholders. You must present your valid pass and your ticket to the to the driver when boarding, otherwise you will yon't be allowed to travel.

Holders of a Scottish National Entitlement Card (NEC) excluding Young Scot Card can travel for free on most coach services wholly within Scotland (i.e. trip must begin, be wholly contained and end in Scotland). Any exclusions are detailed in the relevant Conditions of carriage. Use of the card is subject to the terms set out by Transport Scotland.

Children, young people, TOTUM/NEC, Stagecoach and SCCL Employee and Privilege discounts are only applicable if entered in the relevant area on our website when buying your Tickets online, or by telling the authorised agent taking your booking.  Please check your reservations to ensure such discount has been applied.

The booking fee will still apply on bookings made using a NEC.

No other concessionary travel cards can be used on our services.

12. Amendments

An amendment fee and a booking fee will be applied for each amended reservation.  The amendment and booking fees may be different for changes made with an authorised megabus.com agent or call centre rather than on our website.

If you buy more than one Ticket for the same journey, you will only be able to amend the Tickets as a group and not individually.  We recommend you book Tickets separately if individual amendments may be required later.

You can amend your megabus.com Ticket on our website up to 24 hours before the departure of the first service in your reservation. You will need to pay the difference between the price paid and the next available price for your journey. If the new journey is cheaper, there will be no refund of the difference.

13. Dispatch of tickets

When you order a Ticket from megabus.com or an authorised agent, we will send you a confirmation email or text message, which will contain your Ticket numbers. You must be able to provide these Ticket numbers when you travel.

As we do not provide paper tickets, please check carefully when entering your phone number or email address. It is your responsibility to:

  • provide the correct email address/phone number and have access to that email address/phone number
  • notify us if you change your email address/phone number prior to starting your journey by contacting our Customer Services.

If you have not received your confirmation email or text message within one hour of ordering, please contact our Customer Services.

If you buy a Ticket from an authorised megabus.com agent, you will be given a printed copy of your Ticket.

It is your responsibility to give us a valid email address. If you do not give us a valid email address at the time of booking, you will not receive notices we may send regarding amendments or cancellations.

If you order from a Kiosk, a paper Ticket will be dispensed when you complete your transaction.

14. Text messages

Details of our current fees which will apply at the time of booking are in the FAQs section of our website.

If you choose to receive your Ticket as a text message, there is a charge for each Ticket. This fee is non-refundable. You are responsible for any additional charges made by your network service provider. Delivery is normally within a few minutes of completing your transaction.

We do not guarantee 100% availability or performance of this service nor do we accept any liability for transmission delays or message failures. We will always do our best to ensure this service is available at all times.

You acknowledge and accept that we have no liability or responsibility for the accuracy of the content sent to customers.

15. Our right to amend or cancel

We reserve the right to alter any timetables, suspend, cancel or withdraw services, or terminate a service once it has commenced, with or without notice whether before or after you have bought a ticket on the service, and to substitute an alternative service or refund the fare and transaction fees.

If this occurs less than 14 days before your travel date you will be given a choice between alternative services or a full refund of fare and transaction fees.

16. Our right to vary these Terms

We may alter these Terms from time to time and post the new version on our website, following which the online sale of Tickets will be governed by that new version. It is your responsibility to check the Terms on our website regularly and prior to making any purchases.

Every time you order Tickets from us, the Terms in force and which appear on our website at the time of your order will apply to the contract between you and us.

17. Our liability

If we fail to comply with these Terms, we are responsible for any loss or damage you suffer that is a foreseeable result to both of us at the time you place your order, of our breach of these Terms or our negligence. We are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time we entered into this contract.

We do not in any way exclude or limit our liability for:

  • death or personal injury caused by our negligence
  • fraud or fraudulent misrepresentation
  • anything else which cannot be excluded or limited by any applicable laws, regulations, regulatory requirements and codes of practice of any relevant jurisdiction, as amended and in force from time to time

It is your duty to:

  • mitigate any loss suffered by taking reasonable steps to ensure that, where possible, the loss does not increase, and
  • not take unreasonable steps which may increase the loss.

18. Other important terms

If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.

If any provision or term of these Terms becomes or is declared illegal, invalid or unenforceable for any reason whatsoever, such terms or provision shall be divisible from the other terms and conditions and shall be deemed to be deleted from them. We may transfer our rights and obligations under a contract to another organisation, but this will not affect your rights or our obligations under these Terms.

Unless otherwise stated in these Terms, you may only transfer your rights or your obligations under these Terms to another person if we agree in writing.

This contract is between you and us. No other person shall have any rights to enforce any of its terms, whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise.

These Terms are governed by Scottish Law. This means a contract for the purchase of Tickets through our website and any dispute or claim arising out of or in connection with it will be governed by Scottish law. You and we both agree that the courts of Scotland will have exclusive jurisdiction in the event of any dispute.
